Abstract
Barnardos believes that the Education (Miscellaneous Provisions) Act 2007 downgrades a child’s right to an
education as enshrined in the Irish Constitution. Unlike the Education Act 1998 and the Education (Welfare) Act
2000 in which the child’s right to an education is central, the Education Act 2007 refers to the ‘educational
interests’ of the child. Will this subtle shift in definition make it more difficult to have the child’s right to an
education vindicated?
